Terms and Conditions
The terms governing use of techsportash.com. Supply of our hardware and platform is covered by a separate written agreement; where the two overlap, the signed agreement wins.
Scope and acceptance
These Terms and Conditions govern your use of techsportash.com (the “Site”), operated by TechSport Ash LLC, 4120 Tech Parkway, Suite 200, Austin, TX 78701, United States. By using the Site you accept them. If you do not accept them, please do not use the Site.
Supply of our hardware and software is governed by a separate written agreement between TechSport Ash LLC and the client organisation — typically a master services agreement, an order form and a data processing agreement. Where those documents conflict with these Terms, those documents prevail for the subject matter they cover. Nothing on this Site constitutes an offer capable of acceptance.
Permitted use of the Site
You may view, download and print pages from the Site for your own internal evaluation and reference. You may not:
- Republish, redistribute or commercially exploit Site content without our written permission.
- Use automated systems to scrape the Site at a rate that degrades service for others.
- Attempt to gain unauthorised access to any part of the Site, its servers or connected infrastructure.
- Introduce malicious code, or use the Site in any way that is unlawful or infringes another party's rights.
- Remove or obscure any copyright, trade mark or other proprietary notice.
We may suspend or restrict access where we reasonably believe these restrictions have been breached.
Intellectual property
All content on the Site — text, layout, graphics, the TechSport Ash name and logo, product names, photographs and the underlying code — is owned by TechSport Ash LLC or licensed to us, and is protected by copyright, trade mark and other intellectual property laws.
Quoting a short extract from our research notes with clear attribution and a link to the source page is permitted and welcome. Reproducing a note in full, or using our name or marks in a way that implies endorsement or partnership, is not.
Photography on the Site is licensed stock imagery used for illustration. It does not depict our clients, our athletes or our own facilities unless a caption states otherwise, and it is not sub-licensed to you.
Technical information and specifications
We take care with the technical content on this Site. Product specifications are measured under our own bench and field test conditions and are stated with their conditions where they vary — battery life, for example, depends on sample rate and positioning mode. Real-world figures will differ with configuration, environment and use.
Specifications, features and pricing may change as products develop. The specification that binds us is the one in your signed order form, not the one on this page on the day you read it.
Not medical, clinical or coaching advice
Nothing on this Site, and no output of our platform, is medical advice, a diagnosis, a clinical decision tool or a substitute for the judgement of a qualified practitioner. Our injury-risk models describe changing risk profiles with stated uncertainty; they do not predict injury in individuals and must not be used as the sole basis for a return-to-play, selection or treatment decision. Decisions about an athlete's health belong to qualified clinicians who know that athlete.
The contact form
The contact form on this Site is a demonstration interface. It validates your input in the browser and shows a confirmation message; it does not transmit your message to us. To contact us for real, email support@techsportash.com or call +1 512 555 0198.
Where you do contact us, please do not send athlete-identifiable or health data by unsecured email. Anonymise session files before sending them, and ask us for a secure transfer link if you need to share anything sensitive.
Links to and from the Site
The Site may link to third-party resources. We do not control them, we do not endorse their content by linking to them, and we accept no responsibility for them. Following an external link is at your own risk and subject to that site's own terms.
You may link to any page on this Site provided the link is fair, does not damage our reputation, and does not falsely imply association, approval or endorsement. Framing our pages within another site, or presenting our content as your own, is not permitted.
Availability and changes
The Site is provided on an “as available” basis. We do not guarantee uninterrupted access and may suspend, withdraw or change any part of it without notice for maintenance or any other reason. Service levels for the platform itself are governed by the service level agreement in your contract, not by this section.
We may revise these Terms at any time by updating this page. The version in force is the one published when you use the Site. Please check it periodically.
Limitation of liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
Subject to that, to the maximum extent permitted by law: the Site and its content are provided without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement; and TechSport Ash LLC is not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, data, goodwill or anticipated savings, arising from your use of or inability to use the Site.
Our total aggregate liability arising out of or in connection with your use of the Site is limited to one hundred United States dollars (US$100). Liability arising under a supply contract is governed by that contract's own limitation provisions.
Indemnity
You agree to indemnify TechSport Ash LLC against any claim, loss, liability or reasonable expense arising from your breach of these Terms, your misuse of the Site, or your infringement of any third-party right in connection with your use of the Site.
Governing law and disputes
These Terms, and any non-contractual obligation arising out of or in connection with them, are governed by the laws of the State of Texas and the federal laws of the United States, without regard to conflict-of-law rules.
The state and federal courts located in Travis County, Texas have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site, and you consent to that jurisdiction and venue. If you are a consumer resident in a jurisdiction whose law grants you the right to bring proceedings locally, this section does not remove that right.
If any provision of these Terms is held unenforceable, the remaining provisions continue in full effect and the unenforceable provision is modified to the minimum extent necessary to make it enforceable.
